Subscription Terms

This is a convenience translation of the German original. In case of any discrepancy, the German version shall prevail.

§1 Scope

These Subscription Terms govern the paid Nexmori subscription, which unlocks the full feature set of the Nexmori iOS app. They supplement the general Terms of Service; in case of conflict, these Subscription Terms prevail for the subscription relationship. The Service is operated by Philipp Humburg (the "Operator").

§2 Service and Pricing

The subscription unlocks the app's full feature set — in particular AI-powered document processing, classification, semantic search, and the question-and-answer chatbot. It is offered as a single product with two billing periods, between which you can switch freely:

  • Monthly: €6.99 per month.
  • Annual: €59.99 per year (roughly 29% saving versus the monthly price).

All prices are final prices in euros and include any applicable value-added tax. Billing is handled exclusively through Apple's in-app purchase (see §4).

§3 Free Trial (14 days)

New subscribers receive a 14-day free trial, provided as an Apple introductory offer. The trial requires a payment method on file at sign-up ("card-up-front"). No charge is incurred during the trial.

Unless the subscription is cancelled through iOS Settings at least 24 hours before the trial ends, it automatically converts to the paid subscription for the chosen billing period, and the first charge is applied. The free trial is granted once per user; eligibility is managed by Apple.

§4 Billing through Apple (In-App Purchase)

Purchase, billing, and renewal of the subscription are handled exclusively through Apple's in-app purchase. The contracting party for payment processing and merchant of record is Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland. The Operator offers no separate payment method or web checkout.

The subscription renews automatically for the chosen billing period unless cancelled in time (see §5). The charge is applied to the payment method on file in your Apple account.

§5 Cancellation

The subscription can be cancelled at any time through iOS Settings: Settings → [Apple ID] → Subscriptions → Nexmori. Cancellation takes effect at the end of the current, already-paid billing period; access remains until then. To avoid the next charge, cancel at least 24 hours before the next renewal date.

§6 Refunds

Because Apple is the merchant of record, refunds are handled exclusively by Apple. Refund requests must be submitted through Apple ("Report a Problem" at reportaproblem.apple.com). The Operator can neither collect nor refund payments processed through Apple.

§7 Right of Withdrawal and Waiver (§ 356(5) BGB)

For contracts covering digital services, consumers generally have a 14-day right of withdrawal. By taking out the subscription, however, the user expressly requests that the Operator begin performing the digital service before the withdrawal period expires and acknowledges that the right of withdrawal is lost once performance begins.

This express consent and acknowledgment are obtained at sign-up in Apple's purchase dialog. Once performance begins — that is, upon unlocking the feature set or starting the free trial — the right of withdrawal expires pursuant to § 356(5) of the German Civil Code (BGB). The right to cancel (§5) and the handling of refunds by Apple (§6) remain unaffected.

§8 Price Changes

The Operator may change subscription prices for future billing periods. Any price change will be communicated in good time before it takes effect, via Apple and/or by email. If the price increases, renewal will — in accordance with Apple's rules — only continue after the user's express consent; otherwise the subscription ends at the close of the current period.

§9 Term and Termination

The subscription runs for an indefinite term and renews automatically until terminated by the user (§5) or by the Operator for good cause. Upon termination, access to the paid feature set ends at the close of the paid period. Documents stored locally on the device and their already-built on-device indexes are retained; renewed AI processing requires an active subscription.

§10 Governing Law

The law of the Federal Republic of Germany applies. The Terms of Service apply additionally. Where the user is a consumer with their habitual residence in another Member State of the European Union, the mandatory consumer-protection provisions of their state of habitual residence remain unaffected pursuant to Art. 6(2) Rome I Regulation.
